Terms and Conditions

1. This web site is owned and operated by Web Designers (hereinafter referred to as "the Designer").
2. Neither Web Designers nor the Sponsors of this web site accept any responsibility for the completeness or accuracy of the information held on this web site.
3. A company listing on this web site does not constitute an endorsement of that company by the Designer or any Sponsor.
4. A free listing on this web site is available for any business either based in Wymondham, Norfolk or having an office/trading base in the Wymondham area. A free listing comprises the business name, business classification, postal address, telephone and fax numbers. Listings are entirely at the Designer's discretion.
5. For businesses with an existing web site, a hyperlink to that web site address is available from the free listing for an annual fee (the "Hyperlink Fee") payable by that business (hereinafter referred to as "a Participant") which is currently £25* payable in advance.
6. For businesses without an existing web site, a single page on a pre-designed template for this web site prepared by the Designer is available to a Participant for an annual fee (the "Page Fee") which is currently £99* payable in advance. This will include up to 200 words about the Participant and can incorporate a logo or photograph supplied in a suitable electronic format (as specified by the Designer). Additional charges may be payable to the Designer for any scanning-in of logos, letterheadings, photographs, etc. which may be required - these charges will be advised to the Participant before such charges are incurred.
7. Should a Participant subsequently contract with the Designer for a web presence outside the Wymondham Business web site, the first year's Hyperlink Fee or Page Fee will be refunded in full to the Participant.
8. Unless specifically varied in the Designer’s Confirmation of Appointment or otherwise in writing by the Designer, the following payment terms shall apply: all fees quoted are exclusive of VAT and to the extent that VAT is chargeable in respect of any goods, work or services supplied by the Designer, VAT at the rate in force at the time of supply should be added to payments otherwise due. Invoices will be due for payment strictly within 7 days of submission and must be paid before any work is carried out by the Designer.
9. All fees quoted are subject to review and adjustment by the Designer.
10. In the event that full payment is made later than required by Condition 8. hereof or if only partial payment is made, the Designer may at its absolute discretion charge for administration costs at its maintenance hourly rate together with interest on any monies owed at either the rate of 2% interest per month or at the annual rate of 7% above the base rate published from time to time by Barclays Bank plc, whichever is the greater rate, calculated weekly and compounded monthly. Failure to apply such charges does not constitute a waiver of the option so to charge.
11. The Designer reserves unto itself the right to withdraw a listing, hyperlink, web page or this web site (or any part) at its entire discretion, particularly in the event of any failure to pay its invoices. Upon such withdrawal of its services, the Designer shall be under no liability whatsoever to any Participant, Sponsor or listed business for any costs, losses and damages, howsoever arising, that such Participant, Sponsor or listed business may incur of may have incurred.
12. It is hereby agreed between the Designer and the Participant or Sponsor that where the Designer withdraws its services pursuant to Condition 11. hereof, the Designer may remove any material stored upon any computer or server and shall retain, and shall not be under any obligation to return or provide access to, any and all documents, papers, etc. belonging to the Participant or Sponsor until payment is made in full of all the Designer’s invoices.
13. Copyright in all pages, documents, papers, etc. prepared or caused to be prepared by the Designer is expressly reserved by the Designer.
14. The Participant shall indemnify and save harmless the Designer against any claims that may arise out of the content or nature of the material stored upon any computer or server or which may be prohibited or protected by laws of any country or state relating to copyright, confidentiality or intellectual property.
15. These Terms of Appointment are governed by and subject to English Law.
